By accessing or utilizing the API endpoints, passes, credits, or digital infrastructure provided by TorpiloAPI ("Service"), you ("Subscriber" or "User") agree to be bound by these Terms of Service. If you do not agree to these terms, you are instructed not to access or use the Service.
TorpiloAPI operates exclusively as an open, decentralized community compute protocol and routing network maintained by independent node contributors. TorpiloAPI is not owned, operated, or managed by a single legal entity, corporate body, or sole proprietor. No individual contributor, node operator, or community volunteer holds personal, corporate, or financial liability for network operations.
TorpiloAPI is an independent routing proxy protocol and is strictly NOT affiliated, endorsed, sponsored, or associated with OpenAI LLC, Microsoft Corp, or their subsidiaries. "OpenAI", "GPT", and related model designations are registered trademarks of their respective owners. Users acknowledge and agree that OpenAI LLC holds zero connection to or liability for TorpiloAPI compute passes, credit allocations, node routing, or service delivery. Subscribers agree to hold both OpenAI LLC and TorpiloAPI community contributors fully indemnified and harmless against any operational claims, third-party disputes, or usage risks.
The Service is delivered on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. TorpiloAPI does not guarantee continuous, uninterrupted, or error-free operation of API endpoints. Network latency, upstream provider maintenance, node disconnects, or unexpected outages may occur without liability.
All digital purchases, pass activations, and API credit allocations are final. Users acknowledge that digital compute allocations are consumed upon provisioning. Refunds are strictly discretionary and limited to pro-rata adjustments solely in the event of permanent, unannounced service cancellation initiated by network maintainers.
To the maximum extent permitted by applicable law, TorpiloAPI, its decentralized community contributors, and node operators shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, loss of data, operational downtime, or third-party service fees arising from or related to the use of the Service.
Subscribers are responsible for safeguarding their issued API credentials (`ta-live-key-...`). Sharing credentials beyond designated concurrency limits (2, 4, or 6 active slots) may result in automated socket termination without refund.
TorpiloAPI community maintainers reserve the right to modify these Terms of Service at any time. Continued use of the Service following published updates constitutes acceptance of the modified terms.
